NBCSS Affiliate Program Terms
1. The program
1.1 The NBCSS Affiliate Program ("Program") pays a commission to approved affiliates ("you") for qualifying purchases made by new members you refer to the National Board of Cost Segregation Specialist ("NBCSS"). These terms, the Terms of Membership and Platform Use, the Privacy Notice and the Refund Policy govern your participation. Where they conflict, these terms control for the Program.
1.2 Participation is by application and NBCSS approval. NBCSS may decline any application and may set tiers (currently "standard" and "partner") at its discretion. Approval creates no employment, agency, partnership, franchise or joint-venture relationship. You may not bind NBCSS or speak for it.
2. Commissions
| Qualifying purchase | Commission | Paid |
|---|---|---|
| Practitioner Program enrollment by a referred applicant whose application is approved and whose approval charge is paid and not refunded | US $250 (standard tier) / US $500 (partner tier) | Once per referred person, ever |
| First-year membership by a referred applicant whose approval charge is paid and not refunded | US $50 | Once per referred person, ever |
| Renewals, assessment fees, print, website service, or any other purchase | None | — |
2.1 A commission is earned only when all of the following are true: the referred person was attributed to you (section 3); NBCSS approved the person's application; the approval charge was paid in full; the 45-day hold (section 5) has passed without a refund, chargeback, reversal, cancellation or fraud finding; and your account is in good standing on the payout date.
2.2 One commission per referred person per product, ever. A person who was previously a member, applicant, employee, contractor or affiliate of NBCSS, or who has been attributed to another affiliate, does not qualify. NBCSS's records decide attribution and qualification.
2.3 NBCSS may change commission amounts, tiers or qualifying products on 30 days' notice; changes apply to attributions created after the effective date.
3. Attribution
3.1 Attribution is created only through your unique referral link (/r/<your-code>) or a code entered in the application. The referred person is attributed to you if they start their application within 30 days of clicking your link, and the first attribution wins.
3.2 Attribution is frozen at the moment the application is submitted. Later clicks by the same person do not change it. Attribution expires unused after the 30-day window.
3.3 You may not: use your own link for yourself, your household, your employees, your business partners, or anyone whose fee you pay in whole or in part ("self-referral"); create or use multiple affiliate accounts; alter, cloak, frame or redirect the link; or place it where the user did not knowingly click it.
4. Prohibited promotion and required disclosures
4.1 You must not: make any claim about NBCSS, membership, education, certification or earnings that NBCSS has not published; state or imply that membership, the Program or any course guarantees certification, a credential, a license, continuing-education credit, employment, income or client results; describe NBCSS as approved, accredited, licensed, exempt or endorsed by any government body or licensing board; use the words "certified" or "CCSS" about yourself or others unless the credential has actually been awarded and is current; offer cash, rebates, gifts or fee-sharing to referred persons; use NBCSS marks in domain names, social handles, paid-search keywords or ads without written permission; send unsolicited bulk email or messages; buy traffic that violates any platform's rules; or target minors.
4.2 You must disclose, clearly and near every link, that you are compensated for referrals, in the form required by the U.S. Federal Trade Commission's Endorsement Guides (for example, "Affiliate link — I earn a commission if you join"). You are responsible for compliance with the FTC Act, CAN-SPAM, the TCPA, state consumer-protection laws and the rules of any platform you use.
4.3 You may only use marketing materials NBCSS provides or approves in writing. NBCSS may require you to remove or change any promotion at any time.
5. Hold, refunds, chargebacks and clawback
5.1 Every commission is held for 45 days after the qualifying charge settles. If, at any time before payout, the qualifying charge is refunded (in whole or part), reversed, disputed or charged back, or the application is found to be fraudulent or the referred person is found ineligible, the commission is cancelled.
5.2 If a refund, chargeback, reversal or fraud finding occurs after payout, NBCSS may recover the commission ("clawback") by deducting it from future commissions or by invoicing you, payable within 30 days. Where NBCSS incurs a processor dispute fee because of a purchase you referred, the fee is added to the clawback.
5.3 A pattern of refunds, chargebacks or disputes on your referrals (more than 10% of referred purchases in any rolling 90 days, or three or more in any 30 days) suspends payouts pending review and may end participation.
6. Fraud
6.1 NBCSS may withhold, cancel or claw back any commission, and suspend or terminate your participation, if it reasonably determines that a referral or purchase involved: stolen or unauthorized payment methods; false identities or synthetic applicants; self-referral; incentive schemes; bot, proxy, cookie-stuffing or click-injection traffic; misrepresentation to the referred person; or any violation of these terms. NBCSS's determination is final for Program purposes; you may ask for a review within 30 days.
6.2 NBCSS may require identity verification, a tax form (IRS Form W-9 or W-8) and confirmation of your payout account before any payout, and may report suspected fraud to payment providers and authorities.
7. Payouts
7.1 Earned commissions are paid on request or on NBCSS's payout run, no more often than monthly, once your earned balance reaches US $50. Payouts are made by PayPal or eCheck to the account you verified; payment-provider fees may be deducted. NBCSS may add or change payout methods.
7.2 You are responsible for all taxes on commissions. NBCSS issues the tax reporting the law requires (for example, IRS Form 1099-NEC where applicable) and will not pay out without the required tax form on file.
7.3 Commission statements are available in your affiliate portal. Report any error within 60 days of the statement; after that the statement is final.
8. Term, suspension and termination
8.1 Either party may end participation at any time on notice. NBCSS may suspend or terminate immediately for breach, fraud or reputational risk.
8.2 On termination by you or without cause by NBCSS, earned commissions that clear the hold are paid on the next run. On termination for breach or fraud, unpaid commissions are forfeited. Attribution ends on termination; links stop working.
9. Confidentiality, data and intellectual property
9.1 Commission rates, conversion data and any non-public information about NBCSS or its members are confidential. You receive no personal data about referred persons beyond aggregate statistics and the fact that a referral converted.
9.2 NBCSS grants a limited, revocable license to use the referral link and approved materials for the Program only. All marks and materials remain NBCSS's.
10. Liability and indemnity
10.1 The Program is provided "as is". NBCSS does not guarantee traffic, conversions or earnings. NBCSS's total liability to you under the Program is limited to commissions earned and unpaid.
10.2 You indemnify NBCSS against claims, losses, fines and costs arising from your promotions, your breach of these terms or of law, or your relationship with referred persons.
11. Changes, law, disputes
NBCSS may update these terms on 30 days' notice; continued participation is acceptance. Texas law governs. Contact support (support@nbcss.org) first; allow 30 days for good-faith resolution before any proceeding.
